  NOT TAKING SUPREME COURT CONTEMPT SERIOUSLY AT UMARIA उमरिया: कोर्ट की अवमानना का आरोप के केस में उमरिया एसपी Vikas Kumar Shahwal करीब 8 तिथि से गैरहाजिर है पर CJM Shri Anil Choudhary अभी तक वारंट नहीं जारी कर पाए है। वारंट जारी करने की अर्जी कोर्ट में दाखिल की गई है पर उसपर कार्यवाही के मूड में कोर्ट नहीं आ पाई है। कोर्ट का यह लचीला रुख देख कर दूसरी आरोपी TI Varsha Patel ने भी हाजरी लगाना बंद कर दिया है। इन सबको VIP treatment मिल रहा है। करोना काल मे पुणे की फैमिली कोर्ट ने दो महीनों में ही contempt की कार्यवाही पूरी कर सजा के लिए रिपोर्ट हाईकोर्ट भेज दिया। अब अन्य आरोपी भी इस तरह की छूट कोर्ट से मांगेगे। यह न्याय के सिद्धांत का उल्हनघन है। अन्य मामलों मे अगर कोई एक दिन कोर्ट नहीं आता तो तुरंत warrant जारी हो जाता है पर FIR नहीं लिखने के CONTEMPT CASE मे अभी तक कोर्ट ने कोई वारंट नहीं जारी किया और ना ही ऐसी कोई संभावना नजर आती है। ना उमरिया पुलिस मामला दर्ज करती है और न ही उमरिया कोर्ट कोई कार्यवाही करती है। सिर्फ न्याय होगा इसका भरोसा दिया जाता है पर न्याय करते दिखाई नहीं पड़ता। Um

  सेना को अनुशासन खोने का डर सेना में व्याभिचार क़ानून लागू रहने दें, रक्षा मंत्रालय की सुप्रीम कोर्ट से गुहार -प्रेस रिव्यू अंग्रेज़ी अख़बार  इंडियन एक्सप्रेस  में छपी एक ख़बर के अनुसार रक्षा मंत्रालय ने सुप्रीम कोर्ट में एक याचिका दायर कर अपील की है कि एडल्ट्री क़ानून (व्याभिचार) को सुरक्षाबलों में लागू रहने दिया जाए. ग़ौरतलब है कि सुप्रीम कोर्ट की पाँच जजों की संविधान पीठ ने सितंबर 2018 में एक ऐतिहासिक फ़ैसला सुनाते हुए व्याभिचार क़ानून को रद्द कर दिया था और कहा था कि व्याभिचार कोई अपराध नहीं है. संविधान पीठ के अध्यक्ष तत्कालीन चीफ़ जस्टिस दीपक मिश्रा ने उस समय कहा था, "व्याभिचार अपराध नहीं हो सकता. यह निजता का मामला है. पति, पत्नी का मालिक नहीं है. महिलाओं के साथ पुरुषों के समान ही व्यवहार किया जाना चाहिए." उस समय भी केंद्र सरकार ने अपनी दलील में कहा था कि यह सामाजिक तौर पर ग़लत है और इससे जीवनसाथी, बच्चे और परिवार मानसिक तथा शारीरिक रुप से प्रताड़ित होते हैं. सुप्रीम कोर्ट ने वैवाहिक पवित्रता को एक मुद्दा ज़रूर माना था लेकिन व्याभिचार के लिए दंडात्मक प्रावधान को समानता क

  Adv. Nicky Pokar President Indian Bar Association (Women’s Wing) files complaint U/s 193 of IPC & Sec 42 of Advocates Act against NCLT New Delhi Tribunal Member Sh. Ch. Mohd. S. Tariq for false submissions before Bar Council of Maharashtra & Goa.  On 26th October, 2020 during VC hearing in the Court of Sh. Tariq and Sh. NK Bhola; Sh. Tariq brashly started addressing the family name of a litigant despite being repeatedly requested to refrain, yet he continued insulting the litigant, prompting Adv. Nicky Pokar to lodge a complaint with the Hon’ble President of India, which was referred to the Ministry of Corporate Affairs, thereafter to NCLT New Delhi. Adv. Pokar had also filed an advance copy of the complaint to NCLT New Delhi, basis which Registrar NCLT had sought comments of Sh. Mumbai:Adv. Nicky Pokar had filed a petition on 24th December, 2020, before the Hon. Bombay High Court, seeking directions to National Company Law Appellate Tribunal (NCLAT) for doing away with Physical filing instead enabling e - filing of Appeal and Applications, so that lawyers and litigants outside Delhi aren't in any way disadvantaged. NCLAT on 4th Jan, 2021 enabled e filing but their Standard Operating Procedure in addition to online copy, also sought for mandatory filing of hard copy by the appellant, which according to the petitioner serves no fruitful purpose and otherwise NCLAT by way of exercising power embedded in its rules can dispense with the same, so that additional expenses and inconvenience can be avoided.   COURT COMMENTED THAT HOUSEWIVES ARE BACKBONE ON ECONOMY जस्टिस रमन्ना ने एक नैशनल रिपोर्ट का दिया हवाला जस्टिस रमन्ना ने कहा कि 2011 की जनगणना के अनुसार, करीब 16 करोड़ महिलाएं घरेलू कामकाज में व्यस्त हैं और यही उनका मुख्य व्यवसाय है। वहीं, केवल करीब 57 लाख के करीब पुरुष जनगणना में बतौर व्यवसाय घेरलू कामकाज लिखा है। जस्टिस रमन्ना ने अपने फैसले में हाल में नैशनल स्टैटिकल ऑफिस की रिपोर्ट का भी हवाला दिया है। 'टाइम यूज इन इंडिया 2019' नामक इस रिपोर्ट में कहा गया है कि औसतन, महिलाएं एक दिन में करीब 299 मिनट घरेलू कामों में लगाती हैं और इसके लिए उन्हें कोई पैसा नहीं मिलता है जबकि पुरुष औसतन 97 मिनट घरेलू काम में खर्च करते हैं। पुरुष घरेलू कामकाज में एक दिन में महज 76 मिनट करते हैं खर्च जस्टिस रमन्ना ने कहा कि इसी तरह एक दिन में महिलाएं घर के सदस्यों की देखभाल के कामों में 134 मिनट स्पैंड करती हैं जबकि पुरुष ऐसे कामों में केवल 76 मिनट ही खर्च करते हैं। अगर भारत में एक दिन में इन कामों पर खर्च किए गए कुल समय को जोड़े तो तस्वीर साफ हो जाती है। महिलाएं औसतन 16.9% बिना पैसे के लिए घरेलू

  In its major initiative towards digitisation, NCLAT on 4 th Jan, 2021 activated e-filing of appeals, applications through its portal. Earlier though NCLAT proceedings were conducted on virtual mode but the filing of appeal, application etc…was only through hard copy. Many RO water business are doing extraction of water without proper NOC. It is crime under law.   In October last year, Azad Maidan police had registered an FIR against the Pandyas for groundwater theft worth Rs 73.19 crore over 11 years in connivance with a water tanker operator. As per the FIR, the accused sold nearly 6.10 lakh tankers (of 10,000 litres capacity each) of water with an average cost of Rs 1,200 per tanker for their own benefit. The police had slapped sections 379 and 34 under IPC against the accused based on the evidence provided by Dhoka, the main complainant in the case. Pandyas also allegedly forged building plans to show the presence of wells and obtained power connections illegally to extract water. The Lokmanya Tilak Marg police station filed a chargesheet against the Pandyas on these grounds. Many insurance company design one side agreement and block agents renewal for new business. Any such issues can be raised before district court and judge will send summons to parties. If no settlement happens then court will pass order. Time limit to resolve issue is 6 months. No fees for complaint . The order will be final and no appeal is allowed. Aggrieved party has to go high court as writ petition. Agent can get commission or activate code . Consumer related issue can also be raised at district court and also at consumer court.  This remedy is other than consumer court.
