Adv. Nicky Pokar President Indian Bar Association (Women’s Wing) files complaint U/s 193 of IPC & Sec 42 of Advocates Act against NCLT New Delhi Tribunal Member Sh. Ch. Mohd. S. Tariq for false submissions before Bar Council of Maharashtra & Goa.
On 26th October, 2020 during VC hearing in the Court of Sh. Tariq and Sh. NK Bhola; Sh. Tariq brashly started addressing the family name of a litigant despite being repeatedly requested to refrain, yet he continued insulting the litigant, prompting Adv. Nicky Pokar to lodge a complaint with the Hon’ble President of India, which was referred to the Ministry of Corporate Affairs, thereafter to NCLT New Delhi. Adv. Pokar had also filed an advance copy of the complaint to NCLT New Delhi, basis which Registrar NCLT had sought comments of Sh. Tariq on 27th Oct, 2020, which he didn’t care to reply for two months until an RTI was filed by Adv. Pokar seeking status of her complaint. Pursuant to the RTI query, Sh. Tariq filed his reply on 31st Dec, 2020 to NCLT Acting President copying it to Bar Council of Maharashtra & Goa who sought response from Adv. Nicky Pokar, in her response, Adv. Pokar detailed as to how Sh. Mohd. Tariq indulged in misbehaviour, falsities & threatened her of contempt proceedings for complaining against him and also for seeking response under RTI.
Sh. Tariq in his reply to NCLT Acting President identified himself as ‘Authority’ though ceased to be so in respect of the concerned proceedings. Adv. Pokar alleges irresponsibility on the part of Sh. Tariq who though a judicial officer became judgmental about the proceeding which was not being adjudicated by him. The complaint of Adv. Pokar also raises question as to how and when could the documents of a case which is before a different bench could reach the hands of Sh. Tariq, that too during Christmas vacation.
Sh. Tariq is alleged of multiple falsities in his submission to Bar Council of Maharashtra & Goa and also committing contempt of multiple superior authorities hence action has been sought against him U/s 193 of IPC and imposition of heavy cost for making false and contumacious submissions, including threatening Advocate of Contempt Proceedings.
Various bar associations across the country shocked by the conduct of Sh. Tariq Mohd. resolved to make representation seeking strict and severe action against him for abusing his authority as a judicial officer in assaulting the independence of bar and threatening them with contempt proceedings.
