Thane COURT: चार साल से कोर्ट ने SC ST Act मे FIR का Order नही दिया।

 NO FIR IN SC-ST ATROCITY ACT SINCE 2019 BY THANE SPECIAL COURT JUDGE. CONDUCTING INQUIRY SINCE LAST 4 YEARS TO SAVE POLICE OFFICIAL. 2 JUDGES CHANGED IN 4 YEARS





Thane : एक आदमी ने मुंब्रा POLICE इंस्पेक्टर और dcp पर SC ST Act में crpc 156 का CASE July 2019 में दायर किया। आरोप था कि आरोपियों ने POLICE STATION में जाति सूचक गंदी गली दी और फर्जी केस बनाया। कोर्ट में caste certificate भी दिया पर जज साहब ऑर्डर ही नही कर रहे। अब complainant भी थक चुका है। SC ST ACT में FIR पहले और inquiry बाद में होती है। कोर्ट ने ना अब तक रिपोर्ट मंगवाई न FIR का आदेश दिया। आरोपी पुलिस वाले है और जज साहब के हितेषी है बाकी  संविधान तो इन दोनो की जेब मे है। सुप्रीम कोर्ट के कई आदेश के बावजूद जिला अदालत सोई हुई है। कोर्ट पुलिस के कारण चार साल से FIR नही हो पा रही। ऐसी स्थिति सभी जिलों में है SC ST SPECIAL COURTS में कई मामले सालो से FIR के लिए PENDING है 

The Act was further amended in 2018. Section 18A has been inserted whereby conduct of preliminary enquiry before registration of FIR, or to seek approval of any authority to arrest an accused is no longer required.

1[18A. No enquiry or approval required.-- (1) For the purposes of this Act,--

a) preliminary enquiry shall not be required for registration of a First Information Report against any person; or

(b) the investigating officer shall not require approval for the arrest, if necessary, of any person, against whom an accusation of having committed an offence under this Act has been made and no procedure other than that provided under this Act or the Code shall apply.

(2) The provisions of section 438 of the Code shall not apply to a case under this Act, notwithstanding any judgment or order or direction of any Court.]

RTE & School Quota Of Kalyan Dombivli KDMC Region Thane

 Kalyan Dombivali Municipal Region School Quota and RTE 25% quota details received from RTI reply from KDMC Education department. Almost in all the schools free education seats for income below Rs1lac is vacant .The vacant seats are illegally filled by private school in open category by private schools by taking donations. KDMC education didnot taken any action. Total approved strength of class is 4 times of RTE quota. If RTE 25% quota is 25 then approved students limit is 100 students. Means 75 students from general and 25 from RTE 25% quota. In all the schools students are more than from approved strength and RTE 25% seats are vacant. It means RTE seats are filled by general students. As per RTE Act 2009 poor quota seats ie RTE25% cannot be filled by general quota in any condition and at any class.
