SC: Justice Sanjiv Khanna Recuses From Contempt Hearing Against Justice Pradeep Nandrajog Ex Bombay High Court CJ and Bharti dangre
14 July 2023 Delhi : Supreme Court Judge Shri Sanjiv Khanna denied to hear the contempt petition filed against Bombay High Court Ex Chief Justice and Bharti dangre Judge . Contempt was filed for passing order against SC Constitution bench order Anita Kushwaha vs Pushpa Sadan 2016 . As per this order the access to justice is fundamental right of citizen and non citizen. Sapan Shrivastava filed PIL against illegal operation of CISCE operated ICSE and ISC board at Bombay High Court . In Sept 2019 PIL Civil 159/2016 both the judges passed order and given clean chit to CISCE without State reply, justice hurried is justice buried manner. To safe guard the interest of CISCE they penalize petitioner of Rs 5 Lac and passed order that he cannot file any petition till payment of penalty. It is violation of SC constitution bench order. Inspite of many request by email and verbal both the judges given verbal order to registry that not to accept any petition from Sapan Shrivastava. Till date no circular passed passed by BHC administration.
After Research petitioner come to know that Shri Pradeep Nandrajog has done schooling from ICSE board school shimla. His childrens may have passed from ICSE board school. Smt Bharti dangre also did not disclosed his relation with ICSE board. So to safe guard personal interest they willfully and deliberately done contempt of Hon'ble SC order which is binding for them under article 141.
The SC registrar dismissed the contempt petition of Pradeep Nandrajog under order XV rule 5 of SC rules 2013 under which frivolous petitions are allowed to dismiss by registry. The MA was filed to challenge the registrar order and matter listed on 14 July before Justice Sanjiv Khanna bench. With Undisclosed reason he denied to hear the matter and request CJI to transfer to bench other then him.The other staff of bombay high court also made alleged contemnor for obeying order of Bombay High court without circular and disobeying hon'ble SC order with full knowledge .
As per court no person should follow unconstitutional order which is against rule of law. As many staff at Bombay High Court passed from ICSE board so safe guard their interest they are obstructing petitioner. As per RTI reply from HRD, Maharashtra, Delhi, MP the ICSE is not recognize and CISCE also accepted in Allahabad high court that it is only society and private board with act or executive order.
