E-FIR Against Royal Red Builder Jabalpur For Illegal Minor Minerals Civil Line Police Station

 

Jabalpur: E FIR 921331016220009 dated 07/10/22 (civil Line Police Station) is registered against using illegal source of Minor Minerals for construction of Royal Red in Pachpedi, Jabalpur by R Construction Company in a residential project. According to section 3(e) of the Mines and Minerals (Development and Regulation) Act, 1957 “Minor Minerals” means building stones, gravel, ordinary clay, ordinary sand other than sand used for prescribed purposes, and any other mineral which the Central Government may, by notification in the Official Gazette, declare to be a minor mineral. (For the purposes of this Act, the word "minerals” includes all minerals except mineral oils- natural gas and petroleum). The minor minerals are used in construction work. The Government of India, Department of Mines, vide notification dated 3.2.2000, had declared the ordinary earth used for filling or leveling purposes in the construction of embankment, road, railways, building to be a minor mineral in addition to the minerals already declared as minor mineral. The minor minerals, like ordinary earth, sand, morrum, ordinary clay, stone, etc which is being supplied by the contractors and are used in construction work, are transported only after payment of due royalty and accompanied by a valid form. The payment of royalty should be ensured by asking the supplier to produce the certified copy of the treasury challan evidencing payment of royalty and in cases where the royalty has not been paid on such goods, the requisite amount of royalty be deducted from the payment of the bills to the suppliers and deposited in the relevant government account.

It is a ready to move project with possession offered in Dec, 2019. The project is spread over a total area of 0.66 acres of land. The construction is of 3 floors. An accommodation of 9 units has been provided.

As per allegation accused 1-2 has done illegal mining and transportation of building material ie sand, gitti etc in Bunglow. As per Mining officer the material has been purchased from open market but the accused failed to take mining NOC as per total quantity used. As per law the TP/Bills has to be submitted against total quantity used at Mining officer. Mining officer given chit without verifying and abeted the crime .

As per section 21 of MMDR the accuse has to pay all charges with penalty to mining officer then court will quash the FIR . Else there is punishment of 3-7 years under IPC .

The case is filed for court monitor investigation under CRPC 156(3) as TI RAMESH KAURAV  , civil line police station is not doing investigation on E FIR and giving clean chit . He has not appointed IO till date and neither filing closure report at JMFC court Jabalpur nor doing investigation . Matter will be listed soon.
