UMARIA मजिस्ट्रेट JMFC Abhishek Kumar के ऊपर सुप्रीम कोर्ट में Contempt याचिका दायर, Case Of Lalita Kumari Order Violation.
Delhi: Supreme court में उमरिया मध्यप्रदेश के दो JMFC के खिलाफ civil contempt case दायर किया गया। Petitioner सपन श्रीवास्तव का आरोप है कि Learned Shri Abhishek Kumar ओर Learned Shri Rajan Gupta गलत judicial procedure का पालन करते हुए सुप्रीम कोर्ट के ललिता कुमारी guideline का पालन नही करते है। Recall लगाने पर भी दोनो supreme court के recall order की भी अवमानना करते है। दोनो मजिस्ट्रेट आदेश में दस्तावेज होते हुए भी लिखना की नही लगाया बोलकर cognizable offence की याचिका not maintainable लिख कर खारिज कर दी जाती थी। आरोपी kk Gupta और ashish Shrivastava sub registrar stamp की complaint और 3 recall application supreme court के आदेश के खिलाफ जाकर खारिज कर दी। दोनो ना lalita Kumari guideline मानते है ना mistake correction high court और supreme Court के citation को मानते है और ना ही criminal recall के citation मानते है। तीन recall case इसलिए दायर किया गया की जज को गलती सुधारने का मौका मिले । याचिका में उनकी integrity पर प्रश्न खड़ा किया गया है। हाल ही में एक राजस्थान के जज को integrity नही होने पर compulsary retirement कर दिया गया। सुप्रीम कोर्ट ने कहा कि जज की सत्यनिष्ठा बड़ी चीज है। बिना सत्यनिष्ठा के जनता का कोर्ट से विश्वास उठ जाएगा।
The case of wilfully and deliberate contempt of supreme court constitution bench order of Lalita Kumari vs State of UP in which supreme court made guidelines to register FIR. The Umaria court judicial officers are doing contempt by denying apex court guidelines and challenging the authority . It is also a case of judicial impropriety , adventurism and misconduct . Allegation is that they reject CrPC 156(3) complaints with whimsical orders to protect well wishers. They dismissed 3 recall to rectify mistake and shown disregard to supreme court. They also not call police report and dismiss cases on same day. Soon hearing will be start of civil contempt.
