ACTION SOUGHT AGAINST ADDL. CMM ESPLANADE COURT (MUMBAI) ‘SAYALI DANDE’ IN PETITION
Mumbai: In a shocking incident, Ld. Addl. Chief Metropolitan Magistrate of Esplanade Court (Mumbai) ‘SAYALI DANDE’ passed an order allowing an application for taking over of House Property of Sudeep Kumar Moitra under SARFAESI Act by ICICI Bank, basis forged loan documents and supressing criminal cases pending against ICICI Bank and their officials in respect of the very same house property. On finding the criminalities by ICICI Bank Officials, Sudeep Moitra filed an application U/s 340 of Cr PC i.e. perjury against ICICI Bank officials and their Advocate RL Motwani, signatory to the relevant documents. During the course of proceedings RL Motwani denied to have signed the application, thus apparently a criminal conspiracy was hatched to introduce forged application in court records, loaded of false statements and to take over assets of the borrower – which given the conduct of ICICI Bank’s Ex-CEO Chanda Kochhar is nothing strange and a routine for ICICI Officers to have followed the footsteps of robust culture of criminalisation, many members of various Bar Associations opined.
Sudeep Kumar Moitra applied to the Court of Ld. Addl. CMM ‘Sayali Dande’ seeking action for impersonation and making false submissions on oath by ICICI Officials; scores of rulings were cited by the Advocate of Sudeep Moitra, as to the binding precedents which was not only contemptuously ignored by ‘Ld. Addl. CMM Sayali Dande’ and even no action for even inquiring about a grievous offence of impersonation and making false averments in court was initiated by her, rather was granted reliefs prayed basis a forged document.
Legal experts and office bearers of various Bar Associations are baffled as to under what obligation to ICICI Bank or Adv. RL Motwani; did ‘Ld. Addl. CMM Sayali Tejesh Dande’ covered the tracks of crime by ICICI’s officials and their Advocate. A petition for contempt and seeking police enquiry was filed by Adv. Nicky Pokar ‘President Women’s Wing of Indian Bar Association’ and who is representing Sudeep Moitra.

DeleteThey think the litigants are fools and try to hoodwink them. Can u imagine a magistrate meets the accused police officers in her chambers just before hearing a criminal case against them. Wht is the signal she is, sending.
Amongst the greatest contributor to judicial anarchy, is the conduct of judges themselves, who care the least even if superior court rulings are cited... Often commoners wonder - are they before a kangaroo court or court of equity...high time has come errant and erratic judges are shown their rightful place..
ReplyDeleteThe Matter is before Hon'ble Bombay High Court,and I'm convinced that, the learned High Court Judges would examine the material on record and arrive at a judicial conclusion,till then, it is not right on my part,nor I'm competent to comment.
