UMARIA MP State: उमरिया पुलिस SP विकास शहवाल और उमरिया कोतवाली इसंपेक्टर वर्षा पटेल पर कोर्ट की अवमानना का मुक़दमा दायर किया गया है। शिकायतकर्ता SK Shrivastav के अनुसार करीब ५ शिकायत दोनों अधिकारियो को की गयी थी और CRPC १५४(१) में मामला दर्ज़ करने को अनुरोध किया गया था। पहले वर्षा पटेल ने शिकायत पर कोई ध्यान नहीं दिया बाद में शिकायत CRPC १५४(३) के तहत SP को की गयी। SP ने भी शिकायत पर ध्यान नहीं दिया और उसको दूसरे विभागों में FIR के लिए भेज दिया। शिकायतकर्ता के अनुसार ये सुप्रीम कोर्ट के ललिता कुमारी VS स्टेट ऑफ़ UP २०१३ के आदेश का उल्हंघन है। उनको याद दिलाने पर भी दोनों ने जान बूझ कर सुप्रीम कोर्ट की अवमानना की। ललिता कुमारी आदेश के अनुसार अगर कोई पुलिस अधिकारी COGNIZABLE OFFENCE में FIR नहीं दर्ज़ करता तो मजिस्ट्रेट उसपर CONTEMPT OF COURT के तहत कार्यवाही कर हाई कोर्ट को सजा के लिए कह सकता है। यहाँ तो मामला यह है की दोनों ने ७ दिन के अंदर प्रारंभिक जाँच भी नहीं की और मित्रो को बचाने के लिए शिकायत को २ महीने तक दबा दिया और सर्वोच्य न्यायालय के आदेश की अवमानना की। आर्टिकल १४१ के तहत सुप्रीम कोर्ट का हर आदेश सबके लिए बाध्य है। एक मामले में तो सेशन जज को ही सुप्रीम कोर्ट बुलाया और माफ़ी मांगने पर छोड़ दिया पर उस पर जाँच बैठा कर उसके हर आदेश की जाँच कराई और नौकरी से निकाल दिया। जस्टिस कनन को ६ महीने जेल की सजा दी। आज कल पूरे देश में कई पुलिस वाले मामला नहीं दर्ज़ करते है और कोर्ट का मजाक बनाते है । सुप्रीम कोर्ट ने इसलिए हर district मजिस्ट्रेट को contempt चलाने की अनुमति दी जो ललिता कुमारी आदेश की अवमानना करे। Umaria CJM Anil Chaudhari की कोर्ट में इसकी सुनवाई शुरू हो चुकी है।
The Umaria SP Vikas Kumar Shahwal has violated the Hon'ble Supreme court order and not conducted the investigation of cognizable offence to save his wellwishers . The TI Varsha Patel delibrately disobeyed the apex court order to protect white collor criminals. The Criminal Contempt Petition is filed before Hon'ble CJM Umaria. He will submit report to MP High Court under section 15(2) of contempt of court. Highest punishment in contempt is 6 month with or Fine. Ignorence of the law has no excuse in contempt and it is also case of derelection of duty.

Contemnors/Respondents has will fully disobeyed the Apex court guidelines/order to register FIR in cognizable offence.
CRPC 154- 3) Any person aggrieved by a refusal on the part of an officer in charge of a police station to record the information referred to in subsection (1) may send the substance of such information, in writing and by post, to the Superintendent of Police concerned who, if satisfied that such information discloses the commission of a cognizable offence, shall either investigate the case himself or direct an investigation to be made by any police officer subordinate to him, in the manner provided by this Code, and such officer shall have all the powers of an officer in charge of the police station in relation to that offence.
PROVISION OF CONTEMPT
In
Writ Petition (Criminal) No. 68 of 2008, Lalita Kumari Vs. State of U.P. and
ors the apex court directed the Hon’ble
Magistrates to punish such errant officials violating their guidelines.
“3) A two-Judge Bench of this Court in, Lalita Kumari vs. Government of Uttar
Pradesh & Ors. (2008) 7 SCC 164, after noticing the disparity in
registration of FIRs by police officers on case to case basis across the
country, issued notice to the Union of India, the Chief Secretaries of all the
States and Union Territories and Director Generals of Police/Commissioners of
Police to the effect that if steps are not taken for registration of FIRs
immediately and the copies thereof are not handed over to the complainants,
they may move the Magistrates concerned by filing complaint petitions for appropriate
direction(s) to the police to register the case immediately and for
apprehending the accused persons,
failing which, contempt proceedings must be initiated against such delinquent
police officers if no sufficient cause is shown.”
Contempt
of court signifies not only a wilful disregard or disobedience of its orders,
but such conduct as tends to bring the authority of the court and the
administration of the law into disrespect or to defeat, impair, or prejudice
the rights of witnesses or parties to pending litigation. It is clear from the
above definitions in India the Supreme Court and High Courts act as Court of
Records by virtue of Article 129 and Article 215 of Indian Constitution
respectively.Officials of respondents have failed in their duty to perform it
with due diligence, devotion and integrity. It is also dereliction of duty.
This attitude cannot be without any reason. In Smt.
Mithilesh Kumar Vs. State of U.P. and others, 2011(1) ADJ 40 observed: "54. Corruption is a term known to all
of us. Precise meaning is illegal, immoral or unauthorized act done in due
course of employment but literally it means "inducement (as of a public
official) by improper means (as bribery) to violate duty (as by committing a
felony)."
