Umaria:Why JMFC Magistrate Converted Real Incident Into Imaginary?



सत्य दिनदहाड़े घटना को मजिस्ट्रेट ने  काल्पनिक करार दिया,पुलिस के कथन की अनदेखी  की. 
जनता  के विश्वास को गहरी चोट , लापरवाह अफसरों को राहत !
दिनदहाड़े सुप्रीम कोर्ट की अवमानना हो रही है 


Umaria: JMFC Magistrate Shri Abhishek Kumar passed the order in CRPC 156(3) and converted real incident of death due to negligence into imaginary or media news incident. A 22 year male was died when high voltage electric wire fall down in main road khalesar on 26 Sept 2016 . This  report was published in news papers . The complainant Sapan Shrivastava from Thane and Neeraj from Umaria filed application before JMFC Magistrate Shri Abhishek Kumar Umaria to register FIR . The Complainant enclosed the reply of Police of CM Helpline that Devendra Gupta died due to high voltage wire fall in main road. The series of correspondence was also enclosed in the Criminal complaint under CRPC 156(3). The Complainant has also made SP and Town Inspector party under IPC 166A for neglecting FIR registration in cognizable offence after so many request. As per Hon'ble Supreme Court order in Lalita Kumari Vs State Of UP 2013 the FIR is mandatory in cognizable offence.
As the death is due to negligence on duty so complainant made 2 MPEB East zone Umaria officers as accused for punishment under IPC 304A and 409. The complainant  submitted the notes of argument before Magistrate in early dates and requested to pass order on 11 Jan 2020 as per law. Later the complainant come to know from clerk  that the complaint was rejected without speaking order ie. in single line. As their is provision of uploading final order in E court Umaria website ,the complainant Sapan Shrivastava requested court staffs to upload the single line order in portal. After the several request the speaking order get uploaded in website.
Complainant surprised by the remark of Magistrate that the complaint is based on only media report. The Complainant has not attached any news paper cutting in the petition, but only made statement that he received the information via media of this cognizable offence. The CM Help Line Police remark was also enclosed in complaint which was self explanatory. Magistrate denied the cause of death due to electric current but Police acknowledged the death due to high voltage electric shock. Magistrate also put question that How a person from Thane can come  Umaria to register FIR ? There is no provision in law that only local citizen can file FIR. The complainant no.1 Neeraj was resisdent of Umaria city only. 
As per law any death due to negligence or accident is reported by police to the local court. The JMFC Abhishek Kumar was also having option to check his own record but he ignored it. He also ignored CM Help Line document which can turn the order in favour of complainant . By ignoring the main document JMFC Shri Abhishek Kumar converted true incident into imaginary incident .  This is miscarriage of Justice and now complainant has to go under revision to get order on merit. 

In High Court also few judges are not taking important documents in the order and pass adverse order against the merit .  Hon'ble Supreme Court has laid down provisions to add the points pressed during argument but not placed in order via filing new application in the same matter. The JMFC Shri Abhishek Kumar has also option to rectify mistake by ignoring police statement if he feel so. He can also call police report to check the incident in the interest of Justice. Due to this accidental error the top officers got advantage to neglect duty and responsibilities as per direction of law.

The Petitioner in the case was aggrieved by the fact that the Magistrate recalled his own order and thus had committed gross illegality.

The Respondent on the other hand contended that though the Magistrate has set aside his own order, he had clearly demonstrated that the order procured from directing investigation under Section 156 (3) of the Code of Criminal Procedure was a fraud and it was also alleged by the Respondent that material facts and circumstances were suppressed in the case to obtain the order.

The High Court of Bombay in appeal while dismissing the petition, made the following observations in the case:
The Court noted that there cannot be dispute about the trite principle that a Magistrate does not have any power under the Code of Criminal Procedure to recall, review or reconsider his own order.
The Court further note that the aforesaid principle however, does not cover the case of the present nature where it is not a matter of legality or otherwise of the order passed by the Magistrate but the manner in which the order was procured by misleading the Court by suppressing the material   facts   and   circumstances.
In view of the facts and circumstances, the High Court of Bombay noted that this was not a case where a jurisdiction not vested in the Magistrate was invoked by him. It is a case of bare and simple fraud practised upon the Court and it is trite that fraud vitiates everything. 
Thus, the High Court held that there was no illegality committed by the Magistrate in recalling his own order.

मुम्बई:- 26 सितम्बर 2016 उमरिया शहर के मुख्य मार्ग पर विद्युत तार के टूटने से हुए हादसे में खलेषर निवासी देवेन्द्र गुप्ता की मौत हो गयी थी। इस हादसे के तीन साल बाद जब एक जागरूक नागरिक ने इस मामले की शिकायत न्यायिक मजिस्टेªट प्रथम श्रेणी श्री  अभिषेक कुमार उमरिया में की गयी तो उसे साक्ष्यों के अभाव में विभाग के सम्बन्धित अधिकारियों को अभयदान देते हुए इस शिकायत को खारिज कर दिया।शिकायत कर्ता ने सीएम हैल्प लाईन में उक्त घटना की शिकायत की थी। पुलिस विभाग ने सीएम हैल्प लाईन की शिकायत में यह माना था कि खलेषर निवासी देवेन्द्र गुप्ता की मौत विद्युत तार के टूटने से हुए हादसे में हुई थी। ऐसे में न्यायिक मजिस्टेªट प्रथम श्रेणी अभिषेक कुमार ने जिस प्रकार से याचिका को खारिज किया है, उससे शिकायत कर्ता को इसके खिलाफ सवाल उठाने का हक मिलता हुआ दिखाई दे रहा है।
क्या था मामला:-शिकायत कर्ता एस के श्रीवास्तव  ने सीएम हैल्प लाईन में देवेन्द्र गुप्ता की विद्युत तार के टूटने से हुई मौत के लिए जिम्मेदार विद्युत विभाग के अधिकारियों के खिलाफ एफआईआर दर्ज करने की शिकायत की थी। लगातार शिकायत के कई महीनों बाद भी जब उक्त जिम्मेदार विभागों के खिलाफ कोई कार्रवाई नहीं हुई थी तब थककर न्यायालय की शरण में गये थे। लेकिन वहां से बिना जांच किये ही न्यायालय ने उनकी याचिका को खारिज कर दिया गया। ऐसे में यह सवाल उठता है कि जटिल न्याय प्रणाली में आम नागरिकों कों कैसे न्याय मिल पायेगा।
शिकायत खारिज:- न्यायिक मजिस्टेªट ने परिवादी के अनुपस्थित होने के साथ अपने फैसले में यह कहा है। परिवादी उमरिया जिले का स्थानीय निवासी नहीं है और महाराष्ट्र से उमरिया में होकर तीन वर्ष पुराने मीडिया रिपोर्ट के आधार पर तत्कालीन अभियंतओं , पुलिस अधीक्षक, एवं थाना प्रभारी के विरूद्ध परिवाद पत्र पेष किया है, जो परिवाद पत्र के सद्भाविक होने के उपर प्रष्नचिन्ह उत्पन्न करता है। उपरोक्त दर्षित कारण के आलोक में धारा 203 द0प्र0सं0 के अन्तर्गत निरस्त किया जाता है।

 Kalyan Dombivali Municipal Region School Quota and RTE 25% quota details received from RTI reply from KDMC Education department.
