It is observed in court that he donot allow submission properly to petitioners and disposes the public interest matter ex party without merit. Due to this public causes are suffering and law violators are enjoying. He did ask respondents to file reply and disposing matter frequently. Many of his orders are against the law of the land.
Earlier Shri Naresh Patil listen all PILs very sincerely and asking respondents to clarify their stand. Many times he call GP to know state role in the matter. As he has not created the world record of disposal but his orders are accepted in public domain. Justice Oka is also example of Best Judge of Bombay High Court. He understand the subject and coming prepared in court. In place of petitioner he argue matter with respondent but dont dispose without affidavit in reply.
Now the situation has changed 180 degree . Now no affidavit , no reply, no time , no adjournment allowed direct disposal. The number of disposals of Writ petitions and appeals is still unknown. Daily approx 80% matters are getting disposed .
Such injustice will hurt public cause and against the various supreme court orders. It will created work load at Supreme court where several matters are pending.
One Petitioner says" If Umpire will act as player then the result will be negative, Umpire Should listen both the side the deliver Justice".
Not only PIL he is also disposing Appeal without giving adjournment without any Advocate of otherside without taking any submission on record passing order which can be set aside in two minutes in the Higher Court.
ReplyDeleteIn my PIL which was heard by justice oka and directed to respondent to file reply and no reply was filed and I was out of Mumbai due to some personal difficulties and respondent seeking to file reply and my junior also informed about my difficulties but said PIL has been dismissed
ReplyDeleteThis is not done. Just to create a Record and Impress his Bosses CJ is working hard, but this act creates a bad impression of Justice to the people like us who still believe in Law and order. But instead of just watching what else can we do ?
ReplyDeleteBecause if we file a complaint against CJ who will take action. There is an example in Bombay HC that an Advocate filed a complaint in SC against one Judge. . and the result was he was barred from practicing for one year.
I think we should forget that India is a Democratic country.
