Mumbai: In a PIL 111/2016 (Original) the petitioner challenged that how luggage coaches have been been converted into tiffin coaches without any proper order, the chief justice of Bombay High Court passed a non practical order and supported ban by central railway for travelling in luggage coaches. As per PVT rules of railway there is no ban of travelling in luggage coaches with luggage. The railway advocate also not interrupted her to get PIL disposed.
In the hearing Chief Justice Manjula Chellur did not allowed petitioner in person to speak without advocate.She started blaming petitioner bad habit to file PIL and lack of knowledge in prejudice manner. She never allow any party in person to speak and disobey supreme court order of right to justice. In such disturbed condition by not reading the petition contention and central railway affidavit of reply she passed a non practical order to ban travelling in luggage coaches of EMU also.Every day in peak hours thousands of passengers travel in luggage coaches of EMU. Keeping a picture of Mail Express Luggage coach she passed order about EMU luggage coach. In outgoing trains there is no window in luggage coaches.

If this order obeyed by the railway authorities then Petitioner will file another PIL to save innocent passengers life as per CJ order. Now railway authorities have to change rules of manuals to obey CJ order.By keeping silent The central railway advocate TJ Pandian hided the fact that there is no such ban on travelling luggage coach at Mumbai and CJ did not allowed to speak petitioner .
As petitioner the CJ bench is knowingly disobeying Honorable SC order of Right to justice. As per her only advocates have right to appear in court. The bench also have least knowledge of law which is reflected by many orders. By not reading original issue and passing such unpractical order is risk for nation. In past also lack of knowledge hurted nation. Bombay High Court should respect SC order and should act as per law.
