Mumbai: Public Interest Litigation filed against Food Drug Administration for violation of fire NOC at 86000 approx medical pharma shops in state of Maharashtra at Bombay High Court. As per FDA norms fire NOC is not mandatory for license. Due to this 8 persons lost life in fire incident at Medical Store, Andheri Mumbai .In PIL Petitioner insisting for imprisonment of 86000 shop owners for fire norms violation since last 10 years .
To get fire NOC the structure has to be authorized but many shops are having no or partly OC. So in future many shops will suffer shutdown.
This PIL may be reaction of misbehaving done by a chemist of Marine lines Mumbai. In nexus with police he registered fake FIR of extortion against petitioner. He was behind the bar for 3 weeks. Later session court granted bail for no prima facie evidence . The police arrested accused on face value of complainant. The matter will be raise at High Court that How RTI and PIL activist are ill treated by police on face value of complainant.
The Petitioner also raised important point that Medical shops are operating more than 8 hrs with 1 registered pharmacist . They are allowed to open 8 Hrs only with 1 registered pharmacist but they operate for more than 15 hrs with 1 registered pharmacist.
