Chief justice also ignored the sensibility of the case that dismissal will hurt child education in RTE 25% quota and child can not afford high fees at private school. In past the District Education Officer Thane was not giving admission to child in RTE 25% vacant seat by violating section 3&4 of RTE act 2009. There are thousand of vacant RTE 25% government quota seats but DEO not giving admission to poor children. Earlier the matter was in the bench of Justice Kanade. He took marvelous action and issued summons to concern schools. When the matter was in final stage then Chief Justice Manjula Chellur dismissed the case due to non presence in court .This was first absentee of petitioner in court. Being human being and in the interest of justice as per law she should give next date, but to increase case disposal ratio she dismissed writ petition.In the other benches Judges give second chance to appear and are humble to handle sensitive cases. In many cases of In Person appearance judges argues with respondents and give solution to petitioners.
