Bombay High Court Order SEBI To Work On Mutual Fund Complaint Issue

बॉम्बे हाई कोर्ट का सेबी को शिकायत पर कार्यवाही का आदेश 

Mumbai: झूठ बोलकर म्यूच्यूअल फण्ड स्कीम बेचने की शिकायत याचिकाकर्ता ने सेबी के पास की थी. लगभग सभी बड़ी कंपनिया ये दावा करती है की उनकी सभी म्यूच्यूअल फण्ड स्कीम सेबी से मान्यता प्राप्ता है , पर सेबी कहता है की वह कोई भी म्यूच्यूअल फण्ड स्कीम को certify या approve नहीं करता (Section 28 (1) SEBI Mutual Fund Regulation Act 1996)। 
शिकायत कर्ता नें सेबी को उन सभी कंपनियो पर कार्यवाही की मांग की पर सेबी के अधिकारियो ने शिकायत दबा दी और चुप-चाप 2 साल बैठे रहे।  एक जनहित  याचिका में जस्टिस शांतनु खेमकर की बेंच ने सेबी को शिकायत पर शीघ्र कार्यवाही का निर्देश दिया।  शिकायतकर्ता की मांग है की थी  हर स्कीम में यह लिखा जाये की "कोई भी म्यूच्यूअल फण्ड स्कीम सेबी द्वारा approve नहीं है " पर कंपनियो के हित में सेबी ने शिकायत दबा दी। 

Bombay High Court gave direction to SEBI(Securities and Exchange Board Of India) to take appropriate action as earliest for complaint given to SEBI that Mutual fund companies are selling schemes  in the name of SEBI APPROVAL. Petitioner registered complaint to SEBI 2 years back that top mutual fund companies are claiming that their schemes are duly approved by SEBI. But SEBI in an RTI reply said that they neither approve or certify any mutual fund scheme. SEBI did not acted in the business interest of corporate and never took any action. Petitioner approached the Bombay High Court and Bench said that SEBI has sufficient power to resolve this issue but petitioner said that SEBI did not responded his grievances. So Bombay High Court Hon'ble Justice SHANTANU KEMKAR & M.S.KARNIK, JJ. Bench gave direction to SEBI to act promptly.
As per section 28(1) of Mutual fund regulation act trustee approve mutual fund scheme and AMC has to file the scheme at SEBI.

RTE & School Quota Of Kalyan Dombivli KDMC Region Thane

 Kalyan Dombivali Municipal Region School Quota and RTE 25% quota details received from RTI reply from KDMC Education department. Almost in all the schools free education seats for income below Rs1lac is vacant .The vacant seats are illegally filled by private school in open category by private schools by taking donations. KDMC education didnot taken any action. Total approved strength of class is 4 times of RTE quota. If RTE 25% quota is 25 then approved students limit is 100 students. Means 75 students from general and 25 from RTE 25% quota. In all the schools students are more than from approved strength and RTE 25% seats are vacant.
