Misuse Of Bhagshala play ground Dombivli in Other Activity

The Bhagshala Play ground at Dombivali west Thane. This ground is used by local resident around 2-3 Lacs for jogging and playing activity. But Estate department of Kalyan Dombivli Municipal corporation  is allowing non sports activity in Rs 500 per day to other organizer.It is illegal to change the use of play ground to other purpose as per Bombay High court order.

Our team has observed that KDMC is giving permission for non sports activity which violates the Section 37 of  Maharashtra Regional and Town Planning Act (MRTP Act). Please read the Bombay High Court order published in Time Of India on 1st Feb 2013

“A division bench of Chief Justice Mohit Shah and Justice Anoop Mohta  passed the direction after the government and the civic body could not decide on the non-sport activities for which the ground could be allowed to be used for 30 days in a year, under the Maharashtra Regional and Town Planning Act (MRTP Act). On January 4, the court directed the state to issue a notification specifying the functions that could be held for the said 30 days; under Section 37 (A) of MRTP Act, the state can allow temporary change of user of a playground for that period ”. Directing that all records be brought before the court, the judges ruled that no permission should be given to use the ground for non-sport activities except by the court.
The grounds are utilized without the change of use condition for Carnival, Dance functions, Political Rally, Birthdays etc since last few years. It hurts the interest of young children use this ground for sports activity. Even senior citizens made many complaints about on non sports activity.  Recently Jallosh Utsav used the stalls for commercial purpose of rate about Rs 1000 per day per stall. Many Rides conditions was unfit which can cause any on towards incident. Pacemeker dance academy closed the two gates of Bhagshala Ground for 6 hours . Due to this local childrens and senior citizens suffered. Kindly penalize them for this illegal activity. Kindly follow the Honorable Bombay High Court Instructions at all the play grounds within KDMC region for public interest.

RTE & School Quota Of Kalyan Dombivli KDMC Region Thane

 Kalyan Dombivali Municipal Region School Quota and RTE 25% quota details received from RTI reply from KDMC Education department. Almost in all the schools free education seats for income below Rs1lac is vacant .The vacant seats are illegally filled by private school in open category by private schools by taking donations. KDMC education didnot taken any action. Total approved strength of class is 4 times of RTE quota. If RTE 25% quota is 25 then approved students limit is 100 students. Means 75 students from general and 25 from RTE 25% quota. In all the schools students are more than from approved strength and RTE 25% seats are vacant. It means RTE seats are filled by general students. As per RTE Act 2009 poor quota seats ie RTE25% cannot be filled by general quota in any condition and at any class.
