Bombay High Court RTI Officers Rejects 80-90% RTI Applications Since 2007-2013




Rejection is Very High at Bombay High Court....
The public information officer of Bombay High Court is rejecting the RTI applications using invalid reasons. The data from Bombay High Court Website  reflects that rejection is from 80% to 90% in RTI section of Bombay High Court. Least rejection is on 2010 where 70% is only rejected. In 2012 the 95% of applications has been rejected.  The high courts made different rules other than parent act for RTI. These rules causes rejections in applications. The Public Information officer try that on which ground the application can be rejected so that staff can be relaxed for searching information .
Grounds of rejections:
  1. Postal stamp is not attached – PIO rejects application on the ground that applicant has not enclosed Rs25 registered AD  envelop. He neglect the comment in point no. 9  where information can also be  solicited by ordinary post. PIO reply the rejection by registered post but cannot provide information by ordinary post also.
  2. Information can be asked in 1*3 inch space . If applicant attach a separate sheet then application is rejected by PIO. They have provided limited space so that applicant cannot ask the more information to Bombay High Court.
  3. As the PIO is legally trained, so he know how to reject information on legal ground by giving reference of some other judgments.  He never try to approach applicant if there is some confusion. They simply reject application.
A RTI activist said that PIO SS Kanthale of Bombay High Court is placed for rejection only. He simple deny any information using any clauses. It helps only corrupt and hurt national interest. Bombay High Court made special rule for RTI application but now these rules are creating hurdles in the public interest and corrupt misusing these rules. Rules are for smooth functioning not to create hurdles. Judges should come forward to  reduce rejections for national interest. If the applicant made 1 and 2nd appeal then he gets information but most of the applicant give up in 1st stage only.Bombay High Court PIO should take lesson from Indian Railway where applications are very carefully handled and replied in public interest to stop corruption.

RTE & School Quota Of Kalyan Dombivli KDMC Region Thane

 Kalyan Dombivali Municipal Region School Quota and RTE 25% quota details received from RTI reply from KDMC Education department. Almost in all the schools free education seats for income below Rs1lac is vacant .The vacant seats are illegally filled by private school in open category by private schools by taking donations. KDMC education didnot taken any action. Total approved strength of class is 4 times of RTE quota. If RTE 25% quota is 25 then approved students limit is 100 students.
