REQUEST TO USE TECHNOLOGY TO DEFEAT CORONA. VIDEO CONFERENCING WILL BRING TRANSPARENCY IN COURT.
Hon. Chief Justice & other Hon. Puisne Judges
of Bombay High Court, District – Mumbai
Re: Requesting hearing of court-proceedings/mentioning thru electronic means/audio-video conferencing etc…
Respected Sir;
A. In view of the heightened threat of CORONA, bringing the entire nation at a stand still. Crowded court-rooms are an open invitation to COVID - 19. Numerous of our Hon. Judges, Sr. Advocates & Litigants are in the age group making them most vulnerable to the ‘Virus Attack’. The only thing we can do is social distancing and we’ve the technological wherewithal to implement the same and also carry-out the court proceedings, thru e-mail/e-filing/video-conferencing of court proceedings et al… which will not only solve the problem of overcrowding of Courts-Rooms but importantly will reduce pollution since travelling would get reduced and persons across the hinterland of Maharashtra can also participate in the court proceedings sans the hazard of travel and to that extent lessening the threat of virus transmission thru contagion means. Sir, we consider ‘priciest most’ the lives of our Advocates/Litigants and most importantly Hon. Judges; remote access video-conferencing of proceedings, e-filing etc...is a step to avoid crowding of our court-rooms/premises concomitantly avoiding the community infection.
B. We had come across a recent notification of 17th Mar, 2020 & 20th Mar, 2020 issued by our Hon’ble Court enabling mentioning/ circulation of praecipes thru electronic-mode, if the same is made a permanent feature strengthening/supplementing it thru e-conferencing of proceedings, e-filing etc…undoubtedly will reduce crowding of court and usage of papers received from various untested/unverified sources, an outright risk carrier of CORONA virus.
C. ‘Indian Bar Association’ ever committed to the well-being of our Hon. Judges and fellow Advocates request and pray to ‘Your Honour’; be pleased to pass appropriate directions for forthwith implementation of e-filing and remote access e-conferencing of Court Proceedings, to minimise – usage of paper, carbon footprints and personal appearances in contribution to save ‘HUMANITY’.
With highest of regards’
