DISPUTED JUDGEMENT WILL ENDANGER LIFE OF MILLIONS OF STUDENTS OF COACHING CLASS
VIOLATION OF VARIOUS SUPREME COURT ORDER AGAINST FIRE SAFETY
Mumbai: Chief Justice bench passed the order in a PIL that coaching classes does not need Fire NOC as per Maharashtra Fire Prevention and life safety act 2005. As per order ,the owner of the commercial buildings has to take Fire NOCs. The Petitioner shown the RTI reply that at Thane no coaching classes has applied for Fire NOC, and also quoted the section in the petition. Inspite of that also CJ given clean chit to coaching classes. The Court does not asked the respondent their comments about NOC for coaching classes. In earlier hearing Justice Gavai issued notice to all respondents in same PIL.
As per law every occupier has to take fire NOC , if the building owner failed to take fire NOC then it is the responsibility of occupier to take fire NOC.
Petitioner also was personally targeted for filing various PIL without any reason. Petitioner says that he has given letter to CJ Chamber that it is his duty to raise public issue and now court & authorities will be responsible for any loss of life in coaching classes due to fire.
Recently after fire incident at Surat Municipal corporation and DEO started taking action against all coaching classes at Surat. In March 2019 one boy was killed in fire at coaching class at Bihar. in 2014 more than 50 students jumped from 1st floor after fire in coaching class at Thane.

ReplyDeleteसिध्दांतों की कक्षा में अक्षुण्ण मौलिक अधिकारों मेसे हैं ।यदि - माननीय न्यायालय की किसी पीठ इस के विरूद्ध कोई आदेश पारित किया हैं तो उपलब्ध न्याय प्रक्रिया का आश्रय लेना उचित मार्ग हैं ।
